  • Prevention: Set aside time to do proper research so you can find enough sources. Start creating a list of sources as you’re researching and take good notes. The Rise and Fall of George Santos Is a Lesson for America

A mong the truest words to be written about George Santos came in an August filing from his federal prosecutors, who observed that since December, 2022, “when a New York Times article was published detailing apparent misrepresentations in Santos’s biography, Santos has effectively gone on a speaking tour.”

The final moments of that tour came on Monday, August 19, when Santos pleaded guilty to wire fraud and aggravated identity theft. 

There will still be some encores, and a reunion or two. Sentencing for the 36-year-old former congressman is set for February 2025, and he now faces multiple years in prison as well as hundreds of thousands of dollars in restitution. He will have other moments in front of cameras.

But the freewheeling speaking ceased outside the Long Island courthouse Monday afternoon, when Santos abandoned his claims about a “witch hunt” and instead apologized haltingly for his “unethical” decisions and the “lies” he told himself, vowing to make amends.

Beyond that, there is nothing much left for Santos to say. His rise and fall on the national stage is complete, even if his example lives on.

His was the story of a figure out of Twain, Melville, or even “Goodfellas”—the tale of a grifter from Queens who was always looking for a quick buck and a fun time. Santos was a gambler in more ways than one, whether he was betting on an ability to cheat a pet lover out of donations or actually heading to Atlantic City. He loved the world of entertainment, before he endeavored to entertain the world. He tried out different fields and biographies, sampled call center cubicles and small-time hustles. But he didn’t make it big until he put on the costume of a politician and entered history. In doing so, he exposed the rot at the heart of American politics. He was the perfect symbol of almost everything that is wrong with that staid, officious world; and also a warning of what might be to come.

He served less than a year before he finally got pushed out in December 2023, vowing to wear his expulsion like a “badge of honor,” a la Donald Trump. Unsurprisingly, the hustle continued. Santos’s first quick fix was selling video clips to civilians on the Cameo app , agreeing to say anything, even “Happy Hanukkah,” for the right price. Like usual with Santos, it worked—for a while. The disgraced former congressman broke the record for biggest first day, week, and month on Cameo, the company co-founder and CEO told me earlier this year.

Those videos were fun, as were so many aspects of the Santos saga, but they were only confectionary sprinkles decorating a much more perplexing story. What makes someone lie the way Santos did? And what does it say about the United States that the hustle worked so long–and so well?

These questions are very different than the ones that Santos partially dodged by skipping out on a fully fledged jury trial. They have nothing to do with hearing in painstaking detail where exactly his money went and who helped him hustle it. But they do help to explain why Santos briefly became such a notorious public figure, the chip on his shoulder leading to one of the great performances of the 21st century, a wild ride that people could gawk at but probably not stomach themselves. Certainly, though, there is something interesting–even relatable–about his shameless self-transformation, his desperate bid for celebrity and riches, his attempt to bluster into the stratosphere where titans of power seem to be effortlessly earning, just by being beautiful or amusing or loud. Couldn’t he be all those things, and more? 

He was a product of America, after all, shaped by a culture that encourages myth-makers to rise and thrive. Through his crazy hijinks and dumb luck, he became an American legend, another hustler who got away with the con for a minute, using every trick in the book. He did not break our political system—he just showed how broken it already was. 

Though Santos’s brief moment in Congress is (mostly) receding into the past, these issues are even more urgent. The political climate’s count of hucksters has diminished by one, but has not changed much at all. Santos’s story shows how easy it is to suck up attention and invent a persona, to stave off consequence and leave a trail of victims, while still crying victimization. He understood that liars and losers can win in this country simply by blustering and being outrageous and shameless—and persistent. He’s not alone.

President Richard Nixon startled David Frost in his post-presidency interview when he asserted that “when the president does it, that means that it is not illegal.” In the narrow context he was describing, Nixon was right —not because of any monarchical power held by the president, but because of limits on the power of Congress to regulate certain acts of the president. If Congress can’t regulate a presidential power, Congress can’t make acts around that power “criminal.” This is the core of presidential immunity: the substantive limits on Congress’ power to regulate the president.

But immunity is not just about substance. It’s also about buffers. The core may be constitutional limits. The practice, however, extends immunity beyond that core so as to give presidents the breathing room they need to do their job effectively. How much breathing room is necessary is not determined by the Constitution. It is a judgment, a balance, chosen by the Supreme Court.

The Supreme Court has now extended that buffer in the context of alleged presidential crimes. No doubt, the court affirmed, there is no immunity for unofficial acts, or acts beyond the “outer perimeter of official responsibility.” But when unofficial acts are pursued through official means, and they involve core constitutional powers, then the president may not be held responsible for the exercise of that core presidential authority, and evidence from those official acts may not be demanded when prosecuting the crime.

Thus, in  Trump v. United States,  because the threatened removal of an attorney general is the exercise of core presidential power, evidence about threats to remove the attorney general if he didn’t help Trump overturn the results of the last election cannot be introduced in a prosecution for the acts taken to advance that unofficial objective. The same would apparently be true of an even more extreme example: If, in war, the president orders a general to assassinate a political rival, that order would be immune from prosecution since it involves a core presidential authority — even though its purpose was private, unprotected by the Constitution.

This is the offer of an extreme immunity. Nothing, though, requires any president to accept it. Instead, a president or candidate for president could openly pledge to waive any immunity from prosecution for any acts done to advance an unofficial objective, even if those acts included the exercise of core presidential authority. Issuing such a waiver could become a ritual in any campaign for president. Kamala Harris should begin that ritual tomorrow.

Presidents are free to make this pledge because the breadth of the immunity now granted by the court is not compelled by the Constitution. It is a practical judgment by six justices that presidents need such a buffer to be able to act with “vigor.” But a president or candidate for president could make a different judgment, and declare that they don’t need the extra protection the court has afforded them. “Thank you very much,” a candidate could say, “but I waive any immunity from prosecution for any criminal acts done to promote unofficial ends, including any immunity for official acts done to promote that private crime.” So long as Congress has the power to regulate those acts, that waiver would mean that the president is not above the law.

Not every candidate would make such a pledge. The public would then be right to wonder why a candidate wouldn’t. It is one thing — and certainly true—to say that a president needs to be able to act with vigor within the “outer perimeter of his official responsibilities.” It is quite another to say that the presidency depends upon being able to use official authority to commit private crimes. The Supreme Court’s decision leaves the president presumptively immune from prosecution in such cases—unless a president waives that immunity.

If a series of presidents and candidates for president made this pledge, that would build support for the most likely repair of  Trump v. United States —an act of Congress. The court acknowledged Congress has this power in  Nixon v. Fitzgerald,  when it recognized that Congress could, within limits, modify the immunity that it was granting the president. Presidents could modify it as well, at least as it affected them.

No one, including the president, should be above the law. Congress should make that claim true for all presidents. A candidate for president—such as Kamala Harris—could make that claim true for themselves now.

There are certain writers you should never read before you yourself sit down to write, like P.G. Wodehouse and Tom Wolfe. For if you do, you will not be able to get their voices and rhythms out of your head, and you will have to confront the absolute certainty that you can’t pull off what they did. In Wolfe’s case you’ll find that you can’t quite replicate the raw energy of his prose: the fun; the snap, crackle, pop; the fuzzy effusions of new sociological categories — masters of the universe, social X-rays.

And then there’s his sheer audacity. His essay “Radical Chic” — about a cocktail party the conductor Leonard Bernstein and his wife, Felicia, threw for the Black Panthers in 1970 — begins with Bernstein waking up in the middle of the night in a state of wild alarm. He had mentioned having a bad dream in an interview somewhere, and Wolfe took that little autobiographical morsel and spun it into a grand tour through the inside of Bernstein’s brain. Any responsible journalist can report, “Bernstein had a nightmare,” but Wolfe has the guts to take a flight of fancy and describe the nightmare from the inside, with its moments of narcissistic grandiosity and its descent into degrading humiliation.

Wolfe was known for his style, but it was his worldview that made him. He read Max Weber at Yale and it all clicked : Life is a contest for status. Some people think humans are driven by money, or love, or to heal the wounds they suffered in childhood, but Wolfe put the relentless scramble up the pecking order at the center of his worldview. It gave him his brilliant eye for surfaces, for the care with which people put on their social displays. He had the ability to name the status rules that envelop us in ways we are hardly aware of. He had a knack for capturing what it feels like to be caught up in a certain sort of social dilemma.

He was drawn to times and places where the status rules were shifting. His book “The Right Stuff,” about the U.S. space program, takes place at such a moment. Before, the combat pilots were the tippy-top alpha males in the world of flight, but then along came the astronauts to knock them off their perch. In “Radical Chic,” you can catch glimpses of the old blue-blood Protestant elite — the Astors, the Whitneys, the Rockefellers. But this is 1970. A new crowd is beginning to displace them: the Bernsteins, Barbara Walters. The members of this rising elite have often made their money in culture and the media, and include the formerly unthinkables — Catholics, Jews, Black people.

The old aristocrats had it so easy, those stately bankers in the J.P. Morgan mold. They may have been frequently bewildered about why the masses didn’t like them, but their own place in the social aristocracy was secure. It was right there in their bloodlines — the generations of grandees stretching back centuries. The status rules were simple. All you had to do was live like an English earl and collect European culture by the boatload, and you could cruise through Manhattan amid the sound of others bowing and scraping.
